Privacy Statement

This statement explains what personal data we collect, why we use it and what rights you have. Short and free of legal jargon.

This English version is provided for convenience. The Dutch version of this privacy statement is legally binding.

1. Who is responsible?

Van Borg Agency is responsible for the processing of personal data as described in this statement. We are registered with the Dutch Chamber of Commerce (KVK) under number 42125845, VAT identification number NL005514922B93, and located at Kieler Bocht 104, 9642 CE Veendam, the Netherlands.

2. What data do we collect?

We only collect what is needed:

  • Contact form: name, email address, phone number, company details and the content of your message.
  • Chat assistant: the content of the conversation you have with the assistant.
  • Technical: hashed IP addresses, for example for security and abuse prevention.
  • localStorage: only your theme preference (light or dark).

We use no tracking cookies and no advertising pixels.

3. What do we use your data for?

We use your data for three purposes:

  • following up on your request or question;
  • delivering our services;
  • meeting legal obligations, such as tax record-keeping requirements.

4. How long do we keep your data?

  • Contact requests and chat conversations that do not lead to a client relationship: a maximum of 12 months.
  • Tax records (invoices and payment data): 7 years, as required by law.

5. Who do we share data with?

We only share data with processors we need to deliver our services:

  • Vercel — hosting of our website;
  • Anthropic — the AI model behind the chat assistant;
  • Google — email handling.

Some of these parties process data in the United States. That transfer takes place under the EU-US Data Privacy Framework and/or Standard Contractual Clauses (SCCs).

We never sell your data.

6. Data of our clients

If your service runs with us and we process personal data of your customers in doing so, we act as processor and you as controller. We conclude a data processing agreement for this.

If we engage a new sub-processor, we announce it at least 14 days in advance so you can object.

7. Security

We protect data with encrypted transport (HTTPS/TLS), restrict access to those who genuinely need it and choose storage in the EU region where possible.

8. Your rights

You have the right to:

  • access the data we hold about you;
  • rectify incorrect data;
  • have your data deleted;
  • object to a processing activity;
  • data portability (taking your data with you).

9. Changes

We may update this privacy statement, for example when our services or the law change. The current version is always on this page, with the date of the latest change at the top.
